1. Overview

This website and the brand "Waiinuma" are operated as a personal project by the site editor (referred to as "we", "us" and "our"). By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

2. Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose. We reserve the right to refuse service to anyone for any reason at any time.

3. Payments & Taxes

All payments are processed securely through Stripe. Prices for our products are subject to change without notice. Final prices, including shipping fees, are clearly displayed before checkout completion. Please note: As we operate as a personal business/individual, we do not collect sales tax or VAT. The price displayed is the final price to be paid.

4. Shipping & Delivery

We ship to addresses within the United States and select international locations. Delivery times are estimates and start from the date of shipping. We are not responsible for delays caused by the carrier or customs clearance. Any customs duties or import taxes for international orders are the responsibility of the customer.

5. Returns & Refunds

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately, we cannot offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. Personalized items (digital content upload) may be subject to specific refund limitations.

6. User Content & Licensing

You retain full ownership of the digital content (images, texts, memories) you upload to Waiinuma.

By uploading content, you grant Waiinuma a worldwide, non-exclusive, royalty-free license solely for the purpose of providing the Service (hosting, resizing, and displaying content on your specific Frame or via your shared links). We will never sell your content or use it for marketing purposes without your explicit written consent.

You are solely responsible for the content you upload and for the confidentiality of any sharing links you generate. Waiinuma disclaims all liability regarding content shared publicly by the user.

7. Intellectual Property (Brand)

The software code, website design, brand names, and logos "Waiinuma" are the exclusive property of the site editor.

8. Service Availability & Termination

Waiinuma provides a digital service (hosting and NFC connectivity) associated with a physical product. While we strive to maintain the Service indefinitely, we do not guarantee that the digital portion of the Service will be available in perpetuity.

We reserve the right to modify, suspend, or discontinue the digital Service at any time based on operational capabilities or business viability. In the event of a permanent discontinuation of the digital Service, we will make reasonable efforts to notify users (e.g., via email or website notice) at least 30 days in advance to allow for data retrieval. The physical wooden frame remains your property regardless of the status of the digital service.

9. Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the location of the site editor (United States).
